INTRODUCTION

We are a firm of Solicitors who specialise in undertaking agency advocacy hearings in nineteen County Courts across the Greater Midlands area.

We specialise in conducting Civil and Family Litigation hearings on an Agency basis on behalf of other Firms of Solicitors. Below is an outline of the categories of work we undertake and an overview of the service we provide.

CIVIL LITIGATION

The following types of Civil Litigation hearings are regularly undertaken:

  • Mortgage Repossession Hearings
  • Applications to Suspend Warrants of Possession
  • Mortgage Shortfall Claims
  • Bankruptcy and Insolvency Hearings
  • Return of Goods Hearings
  • Applications for Charging Orders
  • Applications for Garnishee and Attachment of Earnings Orders
  • Allocation/Listing Hearings
  • Case Management Conferences
  • Small Claims Hearings
  • Appeals before the Circuit Judge
  • Infant Approval Hearings

Such hearings are undertaken by Andrew Walters, Natalie Smith and Kelly Smith.

Fee Structure:- Our fixed agency fee for most standard hearings listed for ten minutes or less is £75.00 plus VAT, inclusive of preparation, travel and waiting. More complex hearings with a lengthier time estimate would be attract a higher fee which we will be glad to negotiate with you. This may be a fixed fee or based on an hourly rate dependant on the nature of the hearing. Should you already have a fixed pricing structure for your hearings, then we will be happy to undertake instructions accordingly.

FAMILY AND CHILDREN ACT LITIGATION

The following types of Family Litigation hearings are regularly undertaken:

  • Section 8 (Residence, Contact, Specific Issue and Prohibited Steps) Directions Hearings
  • First Directions Appointments in Ancillary Relief Hearings
  • Financial Dispute Resolution hearings
  • Attendance with Counsel on Final Ancillary Relief Hearings
  • General Interlocutory Family and Divorce Hearings
  • Public Law Children Act hearings
  • Public and Private Law Family and Children Act matters in the Family Proceedings Court.

County Court Public Law, Section 8 and Ancillary Relief hearings are undertaken by Andrew Walters and Natalie Smith.

All FPC hearings are undertaken by Andrew Walters and Natalie Smith.

Fee Structure:- We undertake Family hearings at Public Funding rates for both the County and the Family Proceedings Courts should your client have the benefit of a Public Funding Certificate.

If you are privately retained by your client then our attendances would be charged on an hourly rate as follows:

  • Andrew Walters £130.00 per hour
  • Natalie Smith £100.00 per hour

OUR SERVICE

We aim to provide a complete service to you from the receipt of your instructions to reporting back with the result of the hearing. We will provide you with the name and mobile telephone number of the advocate attending your hearing so as to ensure that you can remain in constant contact with them should the need arise.

It is our practice to telephone you with the result of the hearing immediately after its conclusion. We will e-mail or fax a full report to you before close of business on the day of the hearing and the hard copy report together with your papers will be dispatched via document exchange the following day.

We, wherever possible, will be happy to accept emergency instructions at short notice.

We prefer to provide a quality service in a smaller area rather than aim to provide nationwide coverage. This means that we can undertake your hearings personally rather than sub-contracting large volumes of work to other advocates.

We pride ourselves on being able to provide you with a personal, friendly yet professional service. We have an excellent working relationship with all of our clients which we have maintained over a considerable number of years. We aim to provide a service which you will be happy to continue to use on a regular basis.
